Referral of School-Aged Youth to Adult Basic and Literacy Education (ABLE) Programs
The following information and guidelines are offered in order to assist local program staff and others to determine the eligibility, or ineligibility, of school-aged referrals for service and activities supported by Adult Education Act funds.
Section 312 of the Adult Education Act (P.L. 100-297) defines the term "adult" as an individual who has attained 16 years of age or who is beyond the age of compulsory school attendance under state law. The term "adult education" is defined, for purposes of the act, as instruction or services below the college level for adults who;
- are not enrolled in secondary school;
- lack sufficient mastery of basic educational skills to enable them to function effectively in society;
- do not have a certificate of graduation from a school providing secondary education and who have not achieved an equivalent level of education;
- are not currently required to be enrolled in school; and
- whose lack of mastery of basic skills results in an inability to speak, read, or write the English language which constitutes a substantial impairment of their ability to get or retain employment commensurate with their teal ability.
In Ohio, children between six and eighteen years of age are of compulsory school age and are required to be enrolled in school (section 3321.01 of the Revised Code), Since sixteen and seventeen year olds are subject to the compulsory school attendance law and are required to be enrolled in school, they are therefore ineligible for services and activities provided with Adult Education Act funds unless an acceptable statutory exception to compulsory school attendance is in effect and documented.
The only statutory exception to compulsory attendance which would allow the enrollment of sixteen or seventeen year olds in Adult Basic and Literacy Education programs is full-time employment authorized by an Age and Schooling Certificate, Certificates are issued by the superintendent of the home district or their designee in accordance with Chapter 3331. of the Revised Code. Documentation of certificates is available from the district board of education office, the employer, or the individual youth, and should be verified prior to enrollment, This exception exists for as long as the student remains employed, as noted by the certificate.
